How CLE became mandatory and where it’s headed next

For much of the legal profession’s early history, learning effectively stopped at licensure. Once an attorney passed the bar, there were few formal expectations to keep pace with an evolving body of law. But as the 20th century progressed—bringing rapid expansion in regulatory frameworks, corporate law, and specialized practice areas—that model began to show its limits. The law was changing faster than lawyers were.
By the mid-20th century, concerns about professional competency and public protection were mounting. Other fields, like medicine and accounting, had already begun embracing continuing education as a safeguard against outdated knowledge. The legal industry followed suit. What began in the 1960s as voluntary continuing legal education programs—often hosted by bar associations—quickly gained traction as a necessary tool to ensure attorneys remained effective long after law school.
The turning point came in the 1970s, when states began formalizing these expectations. Iowa is widely recognized as the first to adopt a mandatory CLE requirement in 1971, setting off a wave of adoption across the country. Over the following decades, CLE became embedded in the regulatory fabric of the profession, with states establishing credit hours, ethics requirements, and reporting systems tied directly to maintaining a law license.
At its core, CLE was designed with a clear purpose: to ensure lawyers stay competent, informed, and capable of serving their clients in an increasingly complex legal environment. Yet over time, that mission has often been overshadowed by compliance—reducing continuing education to a checklist of hours rather than a meaningful investment in professional growth.
Today, as the legal landscape undergoes another period of rapid transformation driven by technology, specialization, and shifting client expectations, the profession is once again revisiting the original intent behind CLE. The question is no longer just whether lawyers are learning—but whether they are learning with purpose.
This conversation is only gaining momentum, and the coming years will reveal which solutions take hold and which states step up to lead. As active learning, microlearning, and adaptive and individualized learning continue to reshape how professionals grow, the legal education space stands at a genuinely compelling time of growth.
