Selecting and working with expert witnesses in trademark and branding disputes can determine the outcome of a case, yet even sophisticated law firms often approach this process in an unsystematic and under-informed manner. This CLE program, Expert Witnesses in Trademark and Branding Disputes: What Every Lawyer Should Know, is designed to equip attorneys with the substantive knowledge and practical framework necessary to become informed, discerning consumers of brand expert services.

Trademark and branding cases are not simply disputes over logos, names, or visual similarity. At their core, they concern meaning, perception, and the promises that brands occupy in consumers’ minds. This program begins by grounding participants in essential brand fundamentals so they can properly evaluate expert testimony and ask the right questions. Attendees will gain a clear understanding of what a brand truly is, why brands derive value from perception rather than physical assets, and how trademark litigation ultimately turns on consumer understanding, confusion, dilution, and erosion of brand meaning.

The program explains the two foundational components of branding, story and signals, and why both are critical in likelihood of confusion and dilution analyses. Participants will learn how brand positioning, differentiation, and relevance interact with visual and verbal signals across touchpoints, and why evaluating only one dimension produces incomplete or misleading expert opinions. The session then examines brand equity in detail, focusing on the five dimensions that create brand value: awareness, perception, preference, loyalty, and pricing power. Particular emphasis is placed on understanding what trademark law is actually protecting and how brand damage manifests beyond immediate lost sales.

Attendees will be introduced to the Brand Asset Valuator framework and its four pillars, differentiation, relevance, esteem, and knowledge, with a focus on the critical insight that awareness alone creates no brand value. The program explains why relevant differentiation is the true driver of brand strength and why experts who rely primarily on awareness metrics fail to capture what is actually harmed in trademark disputes. Participants will also explore the “brand cable” concept, which illustrates how brands function as integrated systems in which damage to one strand weakens the entire structure. This systems-based understanding is essential for evaluating infringement, dilution, and remediation claims.

The CLE further addresses how social media has fundamentally changed brand damage and repair. Attorneys will learn why modern brand harm spreads faster, lasts longer, and is more difficult to remediate than in prior eras, and why traditional corrective advertising models often underestimate true damages. The program distinguishes between visible damages, such as lost sales and increased costs, and invisible damages, including lost opportunities, reputational erosion, diminished talent pipelines, and long-term competitive harm. Understanding both categories is critical to assessing damages claims and expert methodologies.

Building on this foundation, the program turns to the practical challenge of identifying true brand experts in a crowded marketplace where nearly everyone claims branding expertise. Participants will learn why “brand expert” is not a meaningful credential, why touching brands is not the same as building brand strategy, and how to distinguish strategists from specialists. The session examines the academic versus practitioner divide, outlining the strengths and limitations of each and explaining why the most effective experts often combine theoretical rigor with real-world strategic leadership.

Attorneys will leave with a concrete, systematic vetting framework built around three critical questions that quickly separate true brand strategists from brand-adjacent professionals. The program also provides guidance on evaluating academ
