This program provides attorneys with practical legal guidance on navigating the evolving joint employer doctrine and its implications for employers that utilize staffing agencies, subcontractors, franchise relationships, or other shared workforce arrangements. As federal and state agencies continue to scrutinize employment relationships under the National Labor Relations Act (NLRA), the Fair Labor Standards Act (FLSA), Title VII, and other employment laws, attorneys must understand how operational oversight, contractual provisions, and day-to-day management decisions can create unintended joint employer liability.
In this CLE Webinar, Amy Moor Gaylord, Partner at Akerman LLP, will draw upon current legal developments, enforcement trends, and significant judicial and administrative decisions to examine the legal standards used to determine joint employer status, the practical impact of varying federal and state approaches, and the risks associated with shared supervision, control, and workforce management.
Learning Objectives
Upon completion of this program, attorneys will be able to:
- Identify the legal standards governing joint employer liability under the NLRA, FLSA, Title VII of the Civil Rights Act, and other applicable federal and state employment laws, including recent regulatory and judicial developments.
- Analyze operational practices, contractual relationships, and workplace control factors that may establish or increase the risk of joint employer status in staffing, subcontracting, franchise, and other shared workforce arrangements.
- Advise clients on legal strategies for structuring business relationships, negotiating contractual provisions, and implementing compliance measures designed to minimize joint employer liability while maintaining lawful operational oversight.
With over 28 years of experience, Amy Moor Gaylord focuses her practice on traditional labor matters and employment litigation for both public and private sector employers with an emphasis on National Labor Relations Board (NLRB) proceedings, union organizing drives, NLRB-conducted elections, arbitration cases, contract negotiations, and employment discrimination matters. She has experience counseling clients in various industries, including healthcare, higher education, not-for-profit, public safety (fire/rescue, police, 911 emergency dispatch centers), hospitality, and entertainment, among others.
